Terms of Service

These Terms of Service ("Terms") govern your access to and use of the business-operations platform at app.mydware.com (the "Service"), operated by MYDWARE IT Solutions Inc. ("MYDWARE", "we", "us"). By accessing the Service you agree to these Terms.

1. Accounts

Access is granted only to authorized users of MYDWARE and its partner organizations. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Shared accounts are prohibited; each user must have their own login.

2. Acceptable use

You agree not to:

• Use the Service to violate any applicable law or third-party right.
• Attempt to probe, scan, reverse-engineer, or defeat security mechanisms of the Service.
• Upload malicious code or content to the Service.
• Use the Service's social-publishing features to distribute spam, harassment, hate speech, fraudulent content, or anything that violates the terms of the downstream platform (Facebook, LinkedIn, X, etc.).
• Use the Service to access third-party integrations (Facebook Pages, LinkedIn, etc.) in a manner that breaches those platforms' terms.

3. Third-party integrations

The Service connects to third-party platforms (Facebook, LinkedIn, X, Microsoft 365, HaloPSA, 3CX, Sophos, Pax8, and others). Your use of those integrations is subject to the terms of each platform. We act only as a technical conduit executing actions you initiate; we do not control those platforms' policies, availability, or pricing.

4. Content ownership

You retain ownership of the records, posts, and files you store or publish through the Service. By using the Service you grant MYDWARE a limited, non-exclusive license to process that content solely to operate the Service on your behalf.

5. AI-assisted features

The Service includes AI-assisted content generation (the Social Scheduler's AI Studio, call-intelligence transcripts, campaign copy). You are responsible for reviewing AI-generated output before it is published. We do not guarantee that AI output is accurate, appropriate, or free of bias. You must not disable the approval workflow for regulated content.

6. Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and emergency patching may occasionally cause downtime.

7. Termination

We may suspend or terminate your access if you violate these Terms, if directed to do so by an authorized administrator of your organization, or if required by law. Upon termination, access to the Service ceases; records are retained or deleted in accordance with the Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYDWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE SERVICE.

10. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

11. Changes

We may update these Terms from time to time. Material changes will be announced inside the Service. Continued use after a change constitutes acceptance.
